BASK Away, LLC (“BASK Away”) Occupancy License Agreement
Carefully read over the following agreement. Make sure everyone in your party is aware of BASK Away’s rental policies.
1. Check-In / Check-Out: Check-in is after 4:00 PM EST and check-out is before 10:00 AM EST. Parking or unloading before check-in is prohibited. No early check-ins or late check-outs; no refunds for late arrivals or early departures.
2. No Smoking: Smoking is strictly prohibited indoors and outdoors. Violations incur a $1,000 fee plus cleaning costs and may result in immediate eviction and forfeiture of payments.
3. Pets & Service Animals: Pets are allowed only at Dog-Friendly properties. Emotional support or comfort animals are treated as pets. Service animals (ADA-defined) are always allowed. Animals must be housebroken and under guest control. Guests are responsible for any damage; misrepresentation may result in eviction and fees.
4. Age Requirements: Guests under 25 must be accompanied by one responsible adult per four young adults, who must remain on property. Reservations made under false pretense are null and void; check-in may be denied or guests may be required to vacate immediately.
5. Minimum Stay & Occupancy: Minimum stay varies by property; high-demand periods may require seven nights, often Saturday-to-Saturday. Maximum occupancy may not be exceeded; gatherings beyond limits require written approval. Violations may result in eviction without refund.
6. Damage & Property Care: Guests are responsible for property, contents, and safety. Furniture and fixtures may not be moved or altered. Damages or excessive cleaning may be charged to the card on file.
7. Housekeeping & Towels: Housekeeping fee is included. Guests must maintain property and leave it in good condition. Bath linens must remain; bring own beach/pool towels.
8. Payments & Fees: A non-refundable reservation fee applies. Payment schedule: 50% at booking, 25% due 120 days prior, balance due 60 days prior; full payment required if booking is
less than 60 days from arrival. Guests are responsible for valid payment information; failed payments may result in cancellation and fees.
9. Cancellations & Refunds: Written cancellation notice via email is required. With travel insurance, follow policy. Without insurance, refund depends on rebooking: if rebooked, refund minus non-refundable fee; if not rebooked, all payments are forfeited. Reservations cannot be transferred.
10. Travel Insurance: Optional coverage protects prepaid, non-refundable expenses, trip interruption, medical emergencies, baggage, sporting equipment, and trip inconvenience such as beach closure. Guests should review coverage with Generali (866-642-5889).
11. License to Occupy: This Agreement grants a revocable license and does not create a Landlord-Tenant relationship. BASK Away may revoke license for violations; guests must vacate immediately. No assignment or transfer allowed.
12. Trust & Safety / Accidental Damage: Coverage via Safely.com provides up to $10,000 accidental contents and $100,000 property/bodily injury. Guests responsible for deductibles or minimum claims. Time-stamped photos may be taken before and after stay. Safely.com may require identity verification or background check; instructions emailed if needed.
13. Severe Weather / Pandemics: No refunds are issued for weather, hurricanes, government restrictions, or pandemics. Guests are responsible for travel insurance. Force majeure events do not void payments except as noted.
14. Pool, Spa & Waterfront: Guests assume all risks using pools, spas, hot tubs, docks, piers, and waterfront features, including slips, drowning, boating accidents, wildlife, and equipment failure. Guests release and indemnify BASK Away and owners except for gross negligence or willful misconduct. Guests are responsible for safety and legal compliance. Pool/spa heat may be limited by season or outdoor temperature, must be requested 48+ hours in advance, and no refunds will be issued for weather, temperature, or operational limitations.
15. Security, HOA & Property Use: Guests are responsible for personal property; BASK Away is not liable for theft, vandalism, or items left behind. HOA/community rules must be followed; violations may result in fines or eviction. No subletting or reservation transfer. Illegal downloading/piracy prohibited; violations may result in $1,000 fee, eviction, and forfeiture of payments. Firearms, weapons (including BB/airsoft guns), and illegal substances are prohibited; violations may result in eviction, fines, and forfeiture of payments. Guests must remove all drugs/tobacco/e-cigarettes upon departure. Use of golf carts requires a signed waiver and compliance with safety rules. Report maintenance issues promptly; no refunds for temporary failures of utilities or appliances. Nearby construction is outside BASK Away’s control; no refunds for noise.
16. Notices: Written notices via certified mail, courier, hand delivery, or email are valid. BASK Away: 11768 Hwy 17 BYP, Murrells Inlet, SC 29576; [email protected]. Certified mail effective three business days after mailing; courier/email effective upon delivery or sending.
17. Governing Law & Legal Terms: South Carolina law governs; disputes resolved in SC courts. Prevailing party entitled to attorney fees. Parties knowingly and voluntarily waive the right to a jury trial. Guests occupy the property at their own risk and release BASK Away and owners except for gross negligence or willful misconduct, including exposure to contagious diseases. Guests agree to defend and indemnify BASK Away and owners from claims arising from breach of this Agreement, except gross negligence or willful misconduct. Invalid provisions do not affect remaining terms. Headings are for reference only. Pandemics or government restrictions do not alter obligations; BASK Away may provide credits, partial refunds, relocation, or full refunds minus non-refundable fees at its discretion.
18. Text / SMS Consent: By providing your phone number, you consent to receive text messages from BASK Away; message and data rates may apply.
19. Authorized Signature: Electronic signature confirms guest has read, understood, and agreed to all terms, including Reservation, Trust and Safety, Accidental Damage Waiver, Golf Cart Liability Waiver, and Swimming Pool Liability Waiver. You authorize charges for damages, deposits, balances, or fees during your stay; this authorization is valid until 90 days after vacating and cannot be challenged.
